天空刚露出鱼肚白,滨江工业园区就响起了机车的轰鸣,推土机、铲土机各种大型的机车在园区河岸上那块开阔地上施展着它们的威力,河滩上半人多高的茅草被推土机连根铲起,铲土机高扬着它超长的手臂把推土机推出来的茅草和泥土铲起倒进一台台运土的汽车。压路机在后面不停地碾压着,过不了多久,这里将平整出来,按照园区的规划建工厂和港口码头。

                                                                                                                                                                杨东林任工业园区主任时就预见到今后工业园区拆迁的棘手,他也有这方面的心理准备,为此他看过国家有关拆迁的法律法规文件,了解这方面的政策。城市房屋拆迁行为本质上应属于民事法律行为。但是,现行法律对拆迁行为性质认识的错位,行政权力的不当介入和拆迁补偿的不到位是当前城市房屋拆迁中公民私权屡受侵犯的根源所在。所以,应对现行拆迁制度进行调整,将拆迁当事人已达成拆迁补偿安置协议作为拆迁许可的法定条件,废除行政裁决制度和强制拆迁制度。同时,真正实现拆迁房屋的市场化定价,并将对拆迁房屋的补偿范围扩大到包括对相关国有土地使用权的损失,实现对被拆迁人公平合理的补偿。如果处理不好,必将引起对抗性的矛盾,影响到社会的稳定。
